जेवर में प्रस्तावित नोएडा इंटरनेशनल एयरपोर्ट देश का सबसे बड़ा हवाई अड्डा होगा। यह दिल्ली के आईजीआई एयरपोर्ट से ढाई गुना और मुंबई के हवाई अड्डे से चार गुना बड़ा होगा। यह बातें केंद्रीय मंत्री डॉ. महेश शर्मा ने सेक्टर-6 स्थित इंदिरा गांधी कला केंद्र में प्राधिकरण की ओर से आयोजित एक कार्यक्रम में कही। उन्होंने कहा कि सेक्टर-14 ए चिल्ला रेगुलेटर से महामाया फ्लाईओवर तक एलिवेटेड रोड का काम शुरू कराने के लिए नोएडा प्राधिकरण के अधिकारी प्रयासरत हैं।
मामले में एनओसी मिलने के बाद काम शुरू हो जाएगा। उन्होंने कहा कि सेक्टर-94 में नोएडा हैबिटेट सेंटर के लिए प्राधिकरण ने 25 एकड़ जमीन दे दी है। इसमें एक बेहतर निर्माण की योजना है, जिससे नोएडा को पहचान मिलेगी। इसके अलावा नोएडा में पाक कला इंस्टीट्यूट बनकर तैयार है। वहीं, देश का पहला बॉटेनिक गार्डन में भी निर्माण कार्य अंतिम चरण में है। यह सब कुछ नोएडा के विकास को दर्शाता है। इसमें नोएडा प्राधिकरण के अधिकारियों का खासा सहयोग रहा।

उन्होंने कहा कि नोएडा को खुले में शौच से मुक्ति की स्वघोषणा की गई है, जिसे वर्षों तक याद रखा जाएगा। इस मामले में प्राधिकरण ने इतिहास लिखा है। उन्होंने कहा कि नोएडा के विकास के लिए बहुत कुछ हुआ। हालांकि कई बार हम चूके भी हैं। इसकी बड़ी वजह दीर्घकालिक योजनाओं का न होना है। कई बार अधिकारियों का तबादला और दूसरी कई बाधाएं आ जाती हैं।


उन्होंने कहा कि लोगों को फ्लैट मिलना शुरू हो गया है। जल्द ही जिले में चार लाख फ्लैटों में लोग आएंगे। इनके साथ अन्य लोग भी आएंगे। कुल मिलाकर 15 लाख लोगों की संख्या बढ़ेगी। इसका असर यातायात सहित कई अन्य सेक्टरों पर पड़ेगा। लिहाजा इससे निपटने के उपाय करने होंगे। उन्होंने कहा कि जिस तरह से हर कोई अपने बराबर में कूड़ा घर नहीं चाहता। इसी तरह से सभी को संकल्प लेना होगा कि अपने बराबर में साफ-सफाई व्यवस्था बनाने में मदद करेंगे।        

उधर, नोएडा इंटरनेशनल एयरपोर्ट परिसर में 50 हजार कारें एक साथ खड़ी हो सकेंगी। पीडब्ल्यूसी की रिपोर्ट के आधार पर इतने वाहनों के लिए करीब 90 हजार वर्ग मीटर जगह तय की गई है। इन कारों के लिए ओपन पार्किंग बनाई जाएगी। जेवर एयरपोर्ट में आने वाले यात्रियों के वाहनों के लिए ओपन पार्किंग का इंतजाम किया जाएगा। एयरपोर्ट के पहले चरण में पार्किंग के लिए 48,491 वर्ग मीटर जमीन आरक्षित की जाएगी, जबकि दूसरे चरण के लिए 39,584 वर्ग मीटर भूमि आरक्षित की जाएगी।

इसमें एक साथ 50 हजार कारें एक साथ खड़ी हो सकेंगी। पर्यावरण मंत्रालय से एनओसी जारी करने के लिए जमा किए गए कागजात में भी इसकी जानकारी दी गई है। दरअसल, इस एयरपोर्ट से एनसीआर के अलावा पश्चिमी उत्तर प्रदेश के सभी जिलों से यात्री निजी या कैब के जरिये एयरपोर्ट पहुंचेंगे। पार्किंग एरिया कम होने पर दिक्कत हो सकती है।

Good news for homebuyers! NBCC may take up unfinished projects of Jaypee Greens, Amrapali in Noida


Earlier this month, Amrapali Group told the Supreme Court that it has given a proposal to the central government for construction of its unsold and future projects by NBCC.

State-run National Buildings Construction Corporation is likely to take up unfinished projects of debt-stressed Jaypee Greens (Jaypee  Infratech) and Amrapali in Noida. According to a report in the Economic Times, the NBCC will ensure the completion of the projects and hand them over to their bona fide owners. However, in return, NBCC has sought full control of the finances through an escrow account.

 
"Money can be arranged for the completion of the projects from balance payments of the buyers and the control of that money should be with NBCC through an escrow account," the ET quoted a member who attended the meeting of a high-level committee constituted by the state government.

According to the report, the charge of the company would remain with the current promoters, or with the Insolvency Resolution Professional (IRP) in some cases.

"NBCC has also advised that Noida Authority and banks should not ask for more money from the home buyers till the time houses are delivered to them. Noida Authority and banks should seek payments only when the buyers are satisfied with their houses," the business daily quoted a source as saying.

NBCC will act as a Project Management Consultant to the projects and ensure their completion by engaging third party construction companies, the report said.  

Earlier this month, Amrapali Group told the Supreme Court that it has given a proposal to the central government for construction of its unsold and future projects by NBCC.

A bench of justices Arun Mishra and U U Lalit asked the Amrapali group to furnish the details of the proposal given to the Centre in 10 days and submit financial details of projects undertaken by it since 2008-09.

Amrapali Group had earlier told the apex court in an affidavit that it was not in a position to complete the projects and hand over possession of flats to over 42,000 homebyers in a time-bound manner.

In June, the UP government had set up a high-powered committee to solve the problems of nearly three lakh homebuyers and impacted parties.  The committee later asked the NBCC to explore the possibility of completing these projects - some of which have been delayed by 13 years.

With the complex litigation involving thousands of refund seeking homebuyers and Jaypee group companies hurtling towards finality in the Supreme Court, Jaiprakash Associates Ltd (JAL) on Monday promised to give possession of 500 flats every month and pay the principal amount of all those who wanted refund.

However, both these offers came with a caveat from JAL counsel Fali S Nariman that the company must be allowed to generate funds by monetising its assets — Rs 2,700 crore from Yes Bank by mortgaging toll collection on Yamuna Expressway for 10 years and Rs 600 crore by disposing of its cement plant in Rewa in Madhya Pradesh.

A bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud, who in September last year had promised the SC would ensure homebuyers seeking refund were paid back only to admit a few days ago that it never thought the task was so mammoth, asked JAL counsel Anupam Lal Das to circulate the proposal among homebuyers and others. It decided to hold day-today hearing to wind up the case.

JAL, which has so far deposited Rs 750 crore, quantified the principal amount due to all refund seeking homebuyers at Rs 1,372 crore. It promised to deposit seven post-dated cheques amounting to Rs 600 crore dated between July 16 and August 27, thus taking the risk of facing criminal consequences if the cheques bounced.

Not only has the Goods and Services Tax simplified tax structure and brought transparency and uniformity into the system, it has also led to reduction of prices in affordable and mid-income housing segments in most parts of the country

The biggest tax reforms since Independence was introduced in the country on July 1, 2017 with the enforcement of Goods and Services Tax (GST).

A dipstick survey that asked developers whether there was any upward revision in prices, had the developers return an unanimously verdict – none!

In the luxury segment, though, prices have shown upward revision due to the new tax regime, in certain markets like the Delhi NCR.

But, as the market is not permitting developers to increase prices after tax, developers are forced to absorb the extra cost brought about by the increase in tax liability.

Price increase in luxury segment is mainly owing to rise in the net tax rates under the new regime. The incidence of service tax and VAT before the GST regime was introduced was around 5.5%. After GST came into force, taxes were revised to 12% of the purchase price of the house.

However, there is an element of input tax credit which is equal to the taxes paid on inputs like cement, steel, and other items including work contracts. But the input tax credit is not sufficient to offset the increased tax liability.

In states like Maharashtra and Karnataka, where the total tax incidence – service tax and VAT – prior to GST was already upward of 10%, GST at 12%, along with input tax

In the NCR markets, too, in midsegment housing, the input tax credit is sufficient to offset the tax liability due to increase in the tax rates.

For projects under construction, the earlier laws of VAT and service tax will apply for invoices or demand notes raised prior to the enforcement of GST (July 1, 2017), while for invoices raised after that, the new GST law will apply, a report said.

At the same time, GST requires businesses to mandatorily pass on the benefit derived from any reduction in the rate of tax or benefit from input tax credit to customers.

The report says that in the real estate sector, the industry is groping in the dark to determine the actual benefit owing to GST, as there is little clarity on how the benefit, if any, must be computed.

The government has been very aggressive, especially with the real estate sector, to investigate businesses for non-compliance with the anti profiteering provisions.


Against this backdrop, businesses should take appropriate steps to evaluate the quantum of benefit to be passed on and the methodology for passing on such benefit, if any, to customers, the report said.

The Union government and the Reserve Bank of India are announcing measures not only to increase the scope of subsidies for a larger customer base, but also to reduce interest rate on home loans, so that affordability factor improves for homebuyers, especially the middle and lower-income group.

The government’s decision to increase cap on carpet area criteria to qualify for interest subsidies under Prime Minister Awas Yojna (PMAY) will increase sale of largersized apartments, as more buyers can now avail the subsidies.

In line with the revised norms, MIG-I category homebuyers with household income between Rs 6 lakh and Rs 12 lakh are now eligible for subsidy for housing units of up to 160 sq metre in carpet area, up from the earlier size of 120 sq metre.


Similarly, MIG-II category homebuyers with household income between Rs 12 lakh and Rs 18 lakh are eligible for subsidy for housing units of up to 200 sq metre in carpet area, up from the earlier size of 150 sq metre.

Earlier this week, the RBI also revised the definition of Priority Sector Lending (PSL) by increasing its ambit to cover more buyers. Now, loans taken to buy a house costing up to Rs 45 lakh in metropolitan cities, and up to Rs 30 lakh in other centres, will come under priority sector lending. This will increase the number of units which qualify for priority sector loans.

Apart from this, the RBI revised housing loan limits under PSL from the existing Rs 28 lakh to Rs 35 lakh in metropolitan centres with population of 10 lakhs and above, and from existing Rs 20 lakh to Rs 25 lakh in other centres, in its bimonthly monetary policy statement, provided the overall cost of the units in the metropolitan centre and at other centres do not exceed Rs 45 lakh and Rs 30 lakh, respectively.

An analysis by a leading property portal, Magicbricks, shows that Greater Noida is the biggest beneficiary in the MIG category after the revision in the PSL norms, as the number of available units for sale in the region have gone up from 31% to 55% of the total available stock. Ghaziabad, where the stocks increased to 40% from 21%, and Noida, from 16% to 29%, were second and third on the list.

Banks are supposed to lend 40% of their total outstanding loan funds

to priority sectors, where default rates are high at around 8%. If the home loan segment above Rs 10 lakh is also included in the priority sector category, where default rates are very low, at around 2%, many banks would like to meet the criteria of PSL by giving home loans in the ticket size between Rs 10 lakh and Rs 35 lakh.
Suggested projects in affordable price is Jaypee Greens Kosmos and Klassic.
As the RBI increased the cap on the cost of houses to Rs 45 lakh, up from Rs 35 lakh, in metro cities to qualify for PSL, many units will now be covered under this.

Therefore, the size of this segment will be large enough for big banks to focus on this category to meet their PSL criteria.

This will increase competition and bankers feel that interest rates in this category will fall.

An analysis by Magicbricks on data for million plus listed properties for sale and resale on its platform shows that as a direct consequence of RBI’s revision of the overall cost of the dwelling unit in urban areas, a significant portion of homebuyers in both Lower-income Group (LIG) and Middle-income Group (MIG) in the Delhi NCR cities of Greater Noida, Ghaziabad, and Noida, will be benefited.

Jaypee group offers 2,000 shares to home buy:-

Earlier this week, Jaypee group promoter Manoj Gaur made an offer of over Rs 10,000 crore before the lenders of Jaypee Infratech to protect the interest of all stakeholders including financial creditors, home buyers and minority shareholders.

Jaypee group has offered 2,000 equity shares of Jaypee Infratech for free to each home buyer as part of its Rs 10,000 crore proposal to revive the bankruptcy-hit real estate firm, sources said.

Earlier this week, Jaypee group promoter Manoj Gaur made an offer of over Rs 10,000 crore before the lenders of Jaypee Infratech to protect the interest of all stakeholders including financial creditors, home buyers and minority shareholders.

Jaypee Infratech, a subsidiary of Jaypee group's flagship firm Jaiprakash Associates, had in 2007 started development of about 32,000 flats in Noida, of which it has delivered 9,500. It has applied for occupancy certificates to hand over 4,500 flats more.

According to sources, Jaypee group in its fresh proposal has offered 2,000 shares each to every home buyer on first registration. About 4.5 crore shares are estimated to be offered at nil consideration.

That apart, the group proposed to bear 50 per cent of stamp duty on behalf of the home buyers on first registration, they said adding the company plans to deliver all apartments in the next 42 months.

Jaypee Infartech will also pay penalty to home buyers as per the agreement and new realty law RERA, sources said.

Jaiprakash Associates has already deposited Rs 750 crore with the Registry of the Supreme Court and the amount would be utilised for refund to home buyers.

Yesterday, lenders of Jaypee Infratech rejected a Rs 7,350 crore bid by Lakshadweep, the highest bidder for the company, as they found it inadequate.

The decision was taken at a meeting of the Committee of Creditors (CoC) that was called to decide on the bid received from Lakshadweep, whose offer was ranked higher than the one presented by Adani Group.

Last year, the National Company Law Tribunal (NCLT) had admitted the application by an IDBI Bank-led consortium, seeking resolution for Jaypee Infratech under the Insolvency and Bankruptcy Code.

The tribunal had appointed Anuj Jain as Interim Resolution Professional (IRP) to mange the company's business.

Later, Jain invited bids from investors interested in acquiring Jaypee Infratech and completing the stuck real estate projects in Noida and Greater Noida. Consequently, Lakshadweep emerged as a front runner to acquire Jaypee Infratech with Rs 7,350 crore bid.

The lenders who rejected the offer are IFCI, India Infrastructure Finance, Life Insurance Corp of India, Union Bank of India, Axis Bank, Syndicate Bank and Corporation Bank, a source told Moneycontrol


Most of the lenders of Jaypee Infratech have rejected Lakshadweep Pvt Ltd’s Rs 7000-crore offer to buy Jaypee Infratech as it was found too low, a source told Moneycontrol. The committee of creditors met on Wednesday and lenders accounting for 42 percent of the company’s debt turned down the offer. For the offer to succeed, creditors accounting for 75 percent of the company’s debt had to approve the offer.

The lenders who rejected the offer are IFCI, India Infrastructure Finance, Life Insurance Corp of India, Union Bank of India, Axis Bank, Syndicate Bank and Corporation Bank, the source said.

Lakshadweep was the sole remaining bidder to buy the stressed assets of the Jaiprakash Associates subsidiary. The company has been run by an insolvency professional, appointed by the National Company Law Tribunal, for almost nine months now. Lakshadweep had earlier outpaced Kotak-Realty Cube and the Adani Group to emerge as the highest bidder for the Noida-based real estate developer and Yamuna Expressway operator.

But Lakshadweep’s prospects dimmed after several creditors objected to the offer, saying it was too low for the company. According to a note prepared by IDBI Bank, Jaypee’s largest lender, the company’s actual value stands at Rs 17,111 while its distress value is pegged at Rs 14,548 crore. Lakshadweep’s Rs 7,000 crore bid pegged Jaypee’s value at less than half of IDBI’s distress scenario number.



Jaypee Greens is one of the 12 companies the Reserve Bank of India referred to the National Company Law Tribunal last year as an insolvency case whose day-to-day running needed to be put in the hands of a professional for resolution of its Rs 9,000-crore debt.

Jaiprakash Associates on Monday made a revised bid of Rs 10,000 crore but the creditors can’t consider its offer as the bankruptcy law bars promoters from making a bid for the company.

The Allahabad bench of NCLT that is hearing the case could now ask all the parties to approach the Supreme Court. The Supreme Court meets May 11 to hear the matter before it breaks for a two-month-long vacation.

Jaypee Infratech had as on March 31, 2018 completed 13,200 houses, according to the Group’s CEO Manoj Gaur

Tense and uncertain as they are, these are also interesting times at the beleaguered Jaiprakash Associates and its subsidiary Jaypee Infratech. From a situation where everyone looked like losing — be it the promoters or banks or home buyers — has emerged a scenario where there could be more than one winner if not all. One constituency whose fate has suddenly somersaulted — and for good — is the home buyer with both Supreme Court and the Tribunal putting their interests on priority. Understandably so.

Jaypee Infratech, the subsidiary at the centre of trouble, had as on March 31, 2018 completed 13,200 houses, according to the Group’s Executive Chairman and Chief Executive Officer Manoj Gaur.

According to a source clued in on the goings on at the Noida-based group, the company is now ready with 13,915 flats. This includes 9,744 units which have been offered for possession and 4,171 units against whom the offer of occupancy is pending. Of the 9,744 units offered for possession, 5,925 units have been registered.

This is a far cry from Jan 7 when the buyers had to choose between seeking a refund or a finished property. At that time, 11,800 buyers had responded with about 2700 buyers asking for a refund and the rest possession. Two factors have since reversed the scenario.

“It’s very, very unlikely the company will be liquidated. If the group isn’t able to retain control of Jaypee Infratech which is also a possibility, it will go Lakshadweep Pvt Ltd. What is clear is that the company will not sink. Plus with the international airport at Jewar coming up in five-six years, property rates have started to improve. So there are not many buyers who will be looking to encash right away,” another source tracking the insider developments at the company said.

The Supreme Court’s April 16 decision to let the insolvency resolution professional and the committee of creditors decide on Jaiprakash’s bid has lifted the morale of the management. That the Apex court also allowed company directors Pankaj Gaur and Sunny Gaur to travel abroad has also brought some relief to the Gaurs and gives hopes that the worst may coming to a close for the family.

But it may be too early to rejoice. The law doesn’t as such allow the existing promoters to bid for the distressed company and if the National Company Law Tribunal allows it, it might open a Pandora’s box with promoters of other stressed companies asking for the same treatment.

What goes in favour of Jaypee promoters is that the company has solid assets that are in excess of its current liabilities and that Jaiprakash Associates’ original offer — before the company became an NCLT case — was far better than any of the bids being considered by the insolvency resolution professional.

“The law may not allow the Gaurs to bid for Jaypee Infratech but the valuations being offered by the bidders are baffling. The assets are worth much more. The creditors have created scenario one, scenario two and scenario three that show the different haircuts they may have to take. There is no need for a haircut if the Jaypee offer is accepted,” the source first quoted above said.

According to a conservative estimate, the value of the company’s assets should not be less than Rs 20,277 crore. This is derived from the hospital being worth Rs. 500 crore, 167-km Yamuna Expressway Rs. 3,500 crore, 900-acre land parcel near Formula-1 track at the circle rate of Rs 7 crore per acre, 1,225 acres in Jewar at circle rate of Rs 3.34 crore per acre, 1,185 acres near Agra at circle rate of Rs 3.28 crore per acre and 10 million square feet FSI at Noida at Rs 2,000 per square feet.

Jaypee Infratech’s offer included this: 10 percent per annum interest on Rs 3,140 crore of sustainable debt and giving away 448 acres against Rs 2,340 crore of debt as well as an issuance of optionally convertible debentures and conversion of debt into equity.

As far as outside bidders are concerned, the race is now down to two — Lakshadweep and the Adani Group — with the former in the front seat. Lakshadweep is a joint venture between Sudhir Valia-led Suraksha Asset Reconstruction Company and Mumbai-based Dosti Reality. Valia is the brother-in-law of Shanghvi and an executive director on the board of his company, Sun Pharmaceutical Industries. Dosti Realty is a real estate company promoted by Shanghvi’s cousin Deepak Goradia.

As per Lakshadweep’s Rs 7,350 crore offer, it will make an upfront payment of Rs 1,200 crore to the banks. It has marked Rs 4,000 crore against the sale of land and another Rs 2,000 crore to be converted into long-term non-convertible debentures. A small equity stake may also be offered to the lenders.

Adani Group has offered Rs 1,200 crore in cash, Rs 3,500 crore of land parcel and Rs 3,000 crore of back-dated instruments.

“If the bidders are also offering land against cash, then what is the problem with accepting Jaypee’s offer? This is like the right hand taking from the left and giving away. With the airport coming up and the real estate bottomed out, land prices can only improve from here,” the first source said, adding any new player coming in would not be able to deliver the remaining flats before 2022. There are around 16,000 flats left to be delivered.

The 167-km-long Yamuna Expressway, a 525-bed super specialty hospital, a Formula-1 track, more than 3,200 acres that also lie in the city of Taj Mahal are assets to not let go. Metro to run deeper into Noida, Ghaziabad by Sept

New Delhi: By September, Delhi Metro will open two new corridors connecting Dilshad Garden to Ghaziabad and Dwarka to Noida Sector

62. The one on the Blue Line would go ahead of Noida City Centre up to Electronic City, DMRC managing director Mangu Singh said. This would take metro connectivity to many far-flung Noida sectors like 34, 52, 59, 61 and 62. The corridor would also touch the Noida-Ghaziabad border on NH-24 where the last station—Noida Electronic City—is located.

The physical work on the corridor is complete except for two or three locations where there were some special requirements. We are hopeful that by September the corridor will be ready,” Singh told TOI.

The much delayed Dilshad Garden to New Bus Stand (Ghaziabad) corridor is also expected to open in September, Singh said. The corridor would benefit those staying near GT Road and interior parts of the district. At present, Ghaziabad has only two stations, Kaushambi and Vaishali on the Blue Line.

“Physical works, including civil and signalling work, are more or less complete and it should be possible to start the corridor by September,” Singh told TOI. “There were some land issues involved, apart from one issue of shifting of transmission lines near Arthala, which has now been done,” he added.

Apart from these two corridors, another extension of the Blue Line (Aqua Line) would move towards Greater Noida, which will be operated by NMRC. The Sector 52 metro station would come up as an interchange station for the Noida – Greater Noida Corridor. This is expected to be opened by 2018-end.

DMRC is also planning to connect the Dilshad Garden-New Bus Stand corridor to Vaishali by constructing a new corridor between Vaishali and Mohan Nagar. There is a separate plan to extend the metro corridor from Noida Sector 62 to Sahibabad through another corridor.

Singh said that detailed project reports for both the Mohan Nagar-Vaishali and Noida Sector 62-Sahibabad corridors have been prepared and submitted to Ghaziabad Development Authority for approval.

Real estate has been a major contributor to the growth of world economy, which is true in the case of India as well, with the residential property segment alone accounting for nearly 56% to the country's GDP.
And, in this segment, it is affordable housing which is believed to be the key enabler for reviving growth in the sector in the coming years, mostly driven by the Modi government's ambitious “Housing for all by 2022“ scheme, as well as its focus on affordable housing.
Industry experts, however, say that although the government's move is commendable and some policy changes have also been made to give a push to the sector, this is still not enough and lots more remains to be done to make housing affordable in the true sense.
“The avowed aim of the Modi government's `Housing for all by 2022' scheme is to construct 2 crore houses in Indian cities, within this time frame. But to achieve this, the government needs to introduce a fast-track approval process for such housing projects, provide suitable financial empowerment to EWS-category buyers, and unlock government-held land parcels on which such affordable housing can be built,“ Anuj Puri, chairman and country head of JLL India, said.
In line with the objective of financial empowerment, an interest subvention or subsidy scheme is necessary to provide cheaper-structured finance to the target categories.Also, the scheme envisions habitable shelters at zero cost to slum dwellers, but provides no tangible solutions for the urban poor who do not live in slums but, nevertheless, hope to own a house in a metro city.
Though the home loan amounts have been increased, the income levels of the targeted people, more often than not, exclude them from loan disbursal amounts of the required magnitude. “If cheap, newly built houses are to become available to such people, and to migrating people who live in slums, appropriate land resources must be allocated. The government owns massive tracts of land that are lying idle, including land held by the Indian Railways, department of heavy industries, the ministry of public enterprises, and port trusts. Such land must be unlocked, the approval process for schemespecific housing projects must be put on fast track, and incentives for private sector participation must be worked out--all, through a massive coordinated effort.Only then will the vision of `Housing for all by 2022' be achievable,“ Puri says.
According to experts, a single-window clearance system alone can bring down the cost of property substantially. Currently, more than 50 approvals from the government and various authorities are necessary for the launch of a real estate project in India.The approval process, including the NoC and licences, take nearly 18-36 months to complete and, if any project gets stuck at some point, it causes further delay. But a single-window clearance system, if implemented, will not only prevent unnecessary delays in the delivery of a project, but also bring down the price of houses by at least 15-20%, making them more affordable.
It is also necessary to bring in the private sector, in a big way, for achieving the targets set out in the scheme. “The private sector has a substantial role to play in turning the dream of `Housing for all' into reality. However, exorbitant land prices coupled with the high costs involved in long-drawn approvals are some of the biggest impediments in moderating the cost of housing, especially in urban areas,“ Vivek Singhal, president (corporate strategy) of M3M Group, said.
Singhal says that the input cost in housing largely consists of three elements--land, con struction cost, and approval cost-taxes. “While construction cost can be brought down by using cost-effective technologies, approval costs can only be brought down by policy initiatives by the state and central governments. Housing can also be made more affordable by development of smaller units, especially in places like Gurgaon, where density norms restrict development of smaller-sized units. Larger projects can also facilitate affordability, through the economies of scale,“ Singhal said.
Some experts and developers, however, believe that apart from the availability of finance, land and regulation, the success of the “Housing for all“ scheme will depend, to a large extent, on execution as well.
“Unfortunately, execution is often given less attention. Apart from execution, the success of the scheme will also depend on improving urban infrastructure, speeding up the process of obtaining approvals, and targeting the actual beneficiary,“ says Dimple Bhardwaj, GM (marketing and corporate communications) of Raheja Developers Ltd, adding that housing can be made more affordable also by making models of subsidization and incentives to developers.
True, some challenges remain. But they need to be overcome--the sooner, the better.
“The Modi government's `Housing for all by 2022' scheme is an effort to provide affordable homes to the urban poor and slum dwellers, at low interest rates. However, to achieve this goal, some challenges must be overcome, like: long gestation period of realty projects, absence of an effective policy framework for EWS and LIG, high urbanization and migration rates, etc. We however, believe that if the necessary policy changes are made and concrete steps are taken to implement them, `Housing for all' would be come a reality,“ Ravish Kapoor, director of Elan Group, said.

NEW DELHI: The Supreme Court today asked the embattled realty firm Jaiprakash Associates Limited (JAL) to deposit Rs 200 crore in two installments by May 10.

The bench headed by Chief Justice Dipak Misra asked the real-estate major to deposit Rs 100 crore by April 6 and the rest by May 10.

The bench, comprising justices A M Khanwilkar and D Y Chandrachud, also asked the firm not to send any notices for default in payment of EMIs to home buyers who have opted for refund.
The top court asked JAL to submit a project-wise chart of home buyers seeking refund so that the amount can be dispersed on pro-rata basis.

"At present we are concerned with the refund and will take later the issue raised by home buyers who want delivery of flats," the top court said.

Meanwhile, JAL informed the apex court that only eight per cent of 31,000 home buyers have opted for refund and the rest want possession of flats.
The firm also told the court that it has received/sought occupation certificate with regard to 13,500 flats so far in 2017-18.

The firm had on January 25 deposited Rs 125 crore in the Supreme Court after being directed to do so to safeguard the interests of home buyers.

The top court had on January 10 directed JAL, the holding firm of JaypeeBSE 3.39 % Infratech Ltd (JIL), to provide details of its housing projects in the country, saying home buyers should either get their house ..
It had refused to accord urgent hearing on a plea of the Reserve Bank of India seeking its nod to initiate insolvency proceedings before the National Company Law Tribunal (NCLT) against JAL, saying it would be dealt with at a later stage.

Home buyers, including Chitra Sharma, had moved the apex court saying around 32,000 people had booked their flats and were now paying installments.

Hundreds of home buyers have been left in the lurch after the NCLT, on August 10 last year, admitted the IDBI Bank's plea to initiate insolvency proceedings against the debt-ridden realty company for defaulting on a Rs 526-crore loan, the plea has said.

Real Estate Showing Signs of Revival:

The dent in sentiment between April to September last year due to the stir caused by the new policy initiatives has now settled, and developers and financial institutions are positive about the coming six months.

There is something to cheer for real estate with positive sentiments surfacing in the realty sector in India.
The uptick stems from better acceptance of structural reforms like RERA and GST that pulled down industry sentiments in the earlier part of the year, according to the latest survey conducted jointly by FICCINaredco-Knight Frank India for the last quarter of 2017 (October–December 2017)..

This revival in sentiments can be attributed to the hope that more organized players will take the lead in the growth of the sector, leading to more transparency and ease of doing business.
Developers agree. “The real estate sector is indeed back to its recovery path. The markets of Delhi NCR saw corrections in some popular housing pockets of Gurgaon and Noida, and the sales volume has increased in these markets in the wake of these price corrections. Also, legislations like GST and RERA have boosted buyers’ confidence. With more clarity coming in on GST, sales are expected to improve further in the months to come,” Harinder Dhillon, VP (sales) of DLF Ltd, says.
Developers say that increasing buyer confidence backed by structural reforms has improved confidence in the realty market.
“During the past one year or so real estate has seen reforms like demonetization, GST and RERA. The realty market, however, absorbed all reforms, which gave much confidence to homebuyers. Now the sector is showing signs of recovery with sales improving in the wake of correction in property prices. Both mid- and affordable-housing segments are registering improvements in sales. Hopefully, it is only a matter of a few quarters for the market to be back on track,” Gaurav Mittal, MD of CHD Developers, said.

Property sales are also believed to be improving because buyers are getting better deals in the market. “The implementation of various reforms has boosted buyer confidence. Also, in the current market situation homebuyers are in a better position to negotiate and grab better deals, leading to improvement in sales,” Ravish Kapoor, director of Elan Group, said.
Industry experts say that residential property market is gradually reviving, but a lot of suppressed sentiment dynamics are still very much at play and the overly adventurous pricing developers indulged in over the past few years have definitely had a part in this.
In such a market environment, discounts – either overt in the form of slashed rates or covert in the form of waived statutory government fees, free parking, etc – have been a significant factor and served to attract buyers. However, not everything is selling equally well.
“If all the other fundamentals for a purchase decision – such as good location, the credibility of the builder, available amenities, overall rational pricing, and RERA registration – buyers feel confident to respond to the added incentives of discounts. Also, what is currently selling is affordable and mid-income housing in the primary sales segment. Premium housing, as well as the resale market, took a big hit after demonetization because they were traditionally targets for unaccounted funds. While the overall market is recovering, premium housing is taking longer to recuperate,” Anuj Puri, chairman of ANAROCK Property Consultants, said.

NEW DELHI: The Jaypee Group has said that there was no wrongdoing or irregularity in creating a charge on the "unencumbered land" by Jaypee Infratech in favour of Jaiprakash Associates (JAL), the parent company. The company said it was "fully committed" to deliver flats to home buyers.

"JAL had been providing support to JIL as a holding company and only a charge was created on the Jaypee Infratech land in favour of JAL's lenders, which included lenders of Jaypee Infratech as well. Besides, all transactions are as per the provisions contained under the applicable statute," Jaypee Group executive chairman and CEO Manoj Gaur said.

Last week, the insolvency resolution professional appointed for Jaypee Infratech had moved the National Company Law Tribunal alleging irregularities in the mortgage of an 858-acre land to secure bank loans of Jaypee Associates. The two companies have several common lenders, including IDBI Bank, ICICI Bank and State Bank of India.

Gaur said the transactions were transparently done at the behest of banks with valuation undertaken by valuers appointed by banks and added that they were done "in normal course with bona fide intention".

Before IDBI Bank moved NCLT at the behest of RBI, the Jaypee Group had proposed to square off Jaypee Infratech's loans by setting aside land parcels at valuations arrived at banks to avoid any hardship to home buyers, a company executive said. "The move did not entail any haircut for the lenders," the executive added.

While Jaypee Infratech had filed a petition against IDBI's move to initiate insolvency proceedings, the company withdrew it "in the interest of home buyers of Jaypee Greens Wish Town and fixed-deposit holders" on the assurance of early approval of a resolution plan, which was being considered by lenders at that time, the executive said

On his part, Gaur said, the group was keen to ensure that home buyers got their flats. "JAL is fully committed to deliver homes to home buyers. In fact, even during the pendency of insolvency proceedings of Jaypee Infratech, JAL as a contractor, continues the construction of homes and has offered possession of over 1,500 homes between August 2017 and January 2018," he said, adding that Jaypee Infratech had already given a detailed schedule under RERA for completion of homes and over 4,000 units would be offered for possession by March 2018. "The group is best suited to meet expectation of home buyers and we consider it to be a sacred responsibility," Gaur said. JAL is one of the companies in the fray for completing construction work as part of the resolution plan although an amendment to the Insolvency and Bankruptcy Code makes it tough for the promoter to bid for a stressed asset.

"The main reason for the liquidity crunch in JIL was the downtrend in the real estate sector, otherwise selling land would have been the first option for the group, instead of selling plants, which were revenue generating and this aspect cannot be brushed aside," he said, adding that the group had got out of several businesses to repay debt to lenders.

नई दिल्ली (बिजनेस डेस्क)। अप्रैल 2016 से पहले होम लोन ले चुके लोगों की शिकायत रही है कि ब्याज दरें घटने का फायदा उन्हें नहीं मिल रहा, क्योंकि यह सुविधा नए लोन पर ही लागू होती है। रिजर्व बैंक ऑफ इंडिया (RBI) ने इसका फैसला कर दिया है। आरबीआई ने बैंकों को लिखा है कि ब्याज दरें कम होने का फायदा पुराने होम लोन ग्राहकों को भी दिया जाए। 1 अप्रैल 2018 से इस पर काम शुरू हो जाएगा।
मालूम हो, अप्रैल 2016 से पहले होम लोन की ब्याज दर बेसरेट से तय होती है। यह फैसला पूरी तरह से बैंक ही करते थे। इसका असर यह होता था कि आरबीआई ब्याज दरें घटाता था, तो पूरा फायदा बैंक उठा ले जाते थे और ग्राहक को कुछ नहीं मिलता था।
इस संबंध में शिकायतें मिलने के बाद आरबीआई ने नया फॉर्मूला बनाया, जो मार्जिनल कॉस्ट ऑफ लैंडिंग रेट यानी एमसीएलआर पर आधारित था। एमसीएलआर फंड्स की लागत से जुड़ी व्यवस्था है। इस तरह अप्रैल 2016 के बाद लोन लोने वालों को एमसीएलआर का फायदा हुआ, लेकिन पुराने ग्राहकों से बेस रेट पर ही लोन वसूला जा रहा था।

अब अपने ताजा आदेश में आरबीआई ने सभी बैंकों से कहा है कि पुराने होमलोन के बेस रेट की गणना भी एमसीएलआर से करें। यह काम 1 अप्रैल 2018 से होगा। अगले हफ्ते तक इस बारे में विस्तृत निर्देश बैंकों तक पहुंचा दिए जाएंगे।
जानकारों का कहना है कि ब्याज दरें ढलान पर हैं, इसलिए आरबीआई इसका दायरा बढ़ाना चाहता है। साथ ही अब आम लोगों को आरबीआई की घटी हुई दरों का फायदा जल्दी मिलेगा। आरबीआई ने दो बातों को ध्यान में रखते हुए यह फैसला किया है। पहला - ब्याज दरें घटने पर एक स्पष्ट पॉलिसी बनाना और दूसरा - इसका फायदा ज्यादा से ज्यादा लोगों तक पहुंचाना।

Supreme Court refuses to stay Jaypee Infratech’s bidding process:

New Delhi: The Supreme Court on Monday refused to stay the bidding process under Jaypee Infratech Ltd’s resolution process that was initiated to raise money for completion of the developer’s delayed projects as part of its debt resolution process.
“The bidding process will continue before the interim resolution professional (IRP),” said Chief Justice Dipak Misra.
Jaypee Infratech is among the 12 companies against whom the Reserve Bank of India (RBI), through its 13 June directive, had asked banks to file insolvency petitions.
Jaiprakash Associates Ltd (JAL), the parent company of Jaypee Infratech, told the court that it had deposited Rs550 crore against its total liability of Rs2,000 crore that it was required to furnish under a September order to protect the interest of home buyers.
Amicus curiae (friend of the court) Pawan Shree Agrawal also told the court that claims of approximately Rs1,150 crore had been received on the online portal where home buyers could submit their claims for refund or possession.
On 22 November, the court had restrained independent directors and promoters of JAL and their family members from transferring any personal assets or property without the court’s permission to safeguard home buyers’ interests. They will be held for criminal prosecution or contempt of court if found in violation of the order, the court held.
The court was hearing an application filed in a public interest litigation by Delhi resident Chitra Sharma, who has booked a home in a Jaypee Infratech project.
On 4 September, the apex court had stayed an order passed in August by the Allahabad bench of the National Company Law Tribunal (NCLT), which initiated insolvency proceedings against Jaypee Infratech. A day later, IDBI Bank Ltd approached the court, seeking restoration of insolvency proceedings against Jaypee Infratech.
